Service Level Agreement

Which SLA applies? This Service Level Agreement applies to the Core Support Package, which provides short-term coordination and compliance support for 0–3 or 6 month engagements.

1. Parties and Purpose

This Service Level Agreement ("SLA") is entered into by and between Fit and Compliant Consulting ("Consultant") and the Client as defined in the Service Schedule. This document sets out the standards, expectations, and nature of the relationship between the parties to ensure seamless compliance and strategic consulting support. The Core Support Package is typically offered as short-term support for a duration of 0–3 or 6 months.

2. Service Scope and Commitment

Fit and Compliant Consulting provides coordination, administrative support, and strategic advisory services. Our commitment includes strategic coordination with accredited education providers, document management for Fit and Proper status monitoring, and regular updates on regulatory landscape changes affecting the Client's FSP operations.

3. Operational Standards

The Consultant shall perform the Services with reasonable skill and care. Service availability is maintained during standard business hours (08:00 - 17:00, Monday to Friday, excluding public holidays). Inquiries made via digital channels will be acknowledged within 24 business hours.

4. POPIA and Data Protection

Fit and Compliant Consulting is committed to the protection of personal information. All processing of personal data will be conducted in accordance with the Protection of Personal Information Act (POPIA) and our internal Privacy Policy. Client data is processed solely for the purpose of fulfilling the service mandate.

5. Limitation of Liability

The Consultant provides coordination and consulting support and is not an accredited education provider or a Substitute Compliance Officer. The Consultant shall not be held liable for losses arising from regulatory decisions made by external authorities or for the accuracy of 3rd party training material. Confidentiality is maintained by both parties during the term of this agreement.

Note: This Service Level Agreement is a summary of the coordination and support services provided by Fit and Compliant Consulting. It does not replace any obligations set by the FSCA, FAIS, QCTO, INSETA, or other regulators. Final responsibility for meeting all regulatory requirements remains with the authorised financial services provider (FSP), Key Individual, and representative.
